What is the difference between financial and operational leasing in Türkiye?

Financial leasing is a regulated activity under Law No. 6361, supervised by the BDDK, where the lessee typically has the option or expectation to acquire the asset. Operational leasing (operasyonel kiralama) is a rental service with no transfer-of-ownership purpose and falls outside that regime. The classification affects licensing, tax and accounting, so we structure each fleet deal under the correct one.

Does a fleet company need a licence?

It depends on the activity. Financial leasing companies must be licensed and supervised by the BDDK under Law No. 6361. Operational leasing and fleet rental do not require that licence but remain subject to commercial, tax and consumer rules. We advise on exactly which activities cross into regulated financing.

Who is liable for accidents and traffic fines in a leased fleet?

Liability is allocated by contract within the limits of Turkish traffic and tort law, with the registered keeper's obligations and the insurance arrangements playing a central role. Ambiguity here is a common source of disputes, so we draft clear allocation, indemnity and insurance clauses between lessor, lessee and driver.

Can telematics and driver data be collected in fleet vehicles?

Yes, but driver and location data are personal data under the KVKK, and the GDPR for EU operations, requiring a lawful basis, transparency and proportionality. We prepare the data-processing framework, driver notices and retention rules so connected fleet management stays compliant.
